Terms and Conditions
NOHA TUKTUK Company Responsibility
We ensure,
- Deliver the vehicle at least 30 minutes before the rental period begins, at the agreed location.
- Provide the exact vehicle type booked, unless an alternative is approved by the renter.
- Hand over all keys and accessories needed for the vehicle’s operation.
If the company cannot meet these commitments, they must notify the renter at least 48 hours in advance, allowing time to arrange an alternative vehicle.
Renter Responsibility
The Renter must:
- Be the sole driver of the vehicle, after receiving a driving lesson from the NOHA team (except scooter and motorbikes) and holding a valid Sri Lankan driving permit.
- Accept responsibility for the actions and any mistakes of anyone you allow to drive the vehicle.
Use of the Vehicle During the Rental Period
The Renter must:
- Regularly check and maintain your tuk tuk brake and engine oil levels according to the Manufacturer’s Specifications, checking them daily or every other day and responsible for the cost of maintaining these levels during the rental period.
- Grease the Tuk Tuk at a local service center every 1,000 km.
- Not use, or allow the Vehicle to be used, for any illegal purpose, racing, contests, or performance tests and in violation of any laws.
- Not use, or allow the Vehicle to be used, to push or tow anything.
- Not carry, or allow the Vehicle to carry, more than 3 passengers in Tuk Tuk, more than 1 passenger in motorbikes and scooters which are the maximum capacity of the Vehicle.
- Not drive or operate the Vehicle while under the influence of alcohol, drugs, or with a blood alcohol level that exceeds the legal limit in Sri Lanka.
- Avoid using the vehicle if it is damaged or unsafe.
- Avoid driving the Vehicle after an accident or collision (including hitting an animal) until approval is obtained from the NOHA TUK TUK.
- Not transport any flammable substances with a flashpoint, or any other explosive or corrosive materials.
- Not place anything on the roof of the Tuk Tuk unless it has roof racks. If roof racks are present, they may only be used to carry surfboards, and no one should sit or stand on the roof.
- Not drive the Tuk Tuk above the speed limit of 40 km/h and Scooter/ Motorbikes above the speed limit of 60 km/h.
- Comply with all local and international laws governing the use and driving of the Vehicle.
- Reimburse the company for any lost, stolen, or downgraded items or accessories during the rental period.
- Return the Vehicle in the same clean condition as it was provided. Failure to do so will result in a fine.
- Must pay for all parking, speeding, traffic violations, and tolls incurred during the rental period.
Where The Renter Can And Cannot Drive The Vehicle
The Renter Driver must:
- Only use the Vehicle on a road which is properly formed and constructed as a sealed, metalled or gravel road;
- Only use the Vehicle on roads in Sri Lanka where it is registered and legally approved for travel according to Sri Lankan law.
- Not use the vehicle off-road.( eg. on a fire trail, beach, track, grassed area or to cross streams or any other body of water).
- Not drive the vehicle in areas affected by natural disasters, such as floods, landslides, or tsunami zones.
- Avoid driving the tuk tuk near wild animals, such as elephants or other species, which could pose a danger to both the driver and the vehicle.
If the renter fails to follow these guidelines and the vehicle is damaged, the renter is responsible for covering the repair costs. By adhering to these conditions, renters help ensure a safe and enjoyable experience with NOHA TUK TUK.
Maintenance, Security, and Safety
The Renter Driver must:
- Keep the Vehicle locked when unattended and always keep the keys under their personal control.
- The company will assist with repairs for any inherent mechanical faults (as determined by the company or their authorized repairer) at no extra cost, as long as the issue wasn’t caused by unauthorized use of the Vehicle or a violation of the rental terms.
- Not carry out any repairs unless authorized by the company. To receive reimbursement for authorized repairs, the Renter must provide an original tax invoice or receipt. The company will reimburse authorized repair costs for mechanical issues if they can be verified; otherwise, no reimbursement will be given.
- Use the Spare parts and mechanical repair cost document to calculate repair or damage costs for the vehicle. For repairs not listed on the repair cost document, the company will obtain a quote from a reputable mechanic and agree on the amount with the Renter before determining any refund.
- If any damage or loss of the vehicle is caused by the Renter, the repair costs will be deducted from the security deposit. If the deposit is insufficient to cover the full cost of the damage, the Renter must pay the remaining amount to cover the expenses.
Return of the Vehicle
The Renter must return the Vehicle to the Company:
- At the agreed location, date, and time, unless the Renter notifies the company of any changes before the return date, and the company agrees to them.
- In the same condition as when received, except for normal wear and tear.
If the vehicle is returned at a different time, date, or location than agreed, a ‘one-way fee’ of up to $2 per kilometer may be charged to return the vehicle to the original location. The Renter will also be responsible for any additional rental charges caused by loss or damage, extended return, or other issues.
Extended Rental Agreement
If you need to extend your rental period, please notify us at least 2 days before your scheduled return date. We will do our best to accommodate your request based on availability and scheduling.
- Extension Fees: The additional rental charges must be paid on the same day the extension is confirmed. If payment is delayed, a 10% fee will be added to the extension charges for each day of delay.
- Late Return Without Notice: If the tuk tuk is returned late without prior notification, a fee of the daily rental rate + 50% will apply for each additional day.
To avoid any extra charges, please let us know in advance if you expect a delay or need an extension.
Fuel
The company will provide the vehicle with at least 2 liters of fuel at the start of the rental period.
The Renter must return the vehicle:
- With at least the same amount of fuel it had when received. If not, the Renter will be charged for the missing fuel.
- And the Company will visually check the fuel gauge and consider the kilometers driven to determine the fuel level at the time of return. If a Fuel Service charge applies, it will be based on the actual amount of fuel needed to refill the vehicle to its original level.
Loss Damage Waiver, Damage, and Loss of Property
The Renter is responsible for
- any loss or damage to the vehicle during the rental period, as well as damage to others’ property caused by the Renter or anyone driving the vehicle with permission.
- If an accidental collision occurs, the renter must contact the company immediately.
The Company is not responsible for injuries to the driver or passengers. However, they will help claim compensation from their insurance if available.
The Renter is responsible for costs such as:
- Repairing damage caused by reckless driving, water damage, or damage to accessories.
- Replacing lost or stolen accessories.
- Compensating the company for lost income if the vehicle is out of service due to damage. For Tuk Tuk you may need to $10/day and for Motorbike/Scooter you may need to pay $5/day.
- Covering towing and administrative fees.
The amount the Renter has to pay for damage will be either the cost of repairs or the market value of the vehicle, whichever is less.
The Company can charge the Renter’s account for these costs and will refund any excess amount if the final costs are less than what was initially charged.
Security Deposit Policy
A refundable security deposit of $150 for tuk tuk and $100 for motorbikes/scooters are required at booking. We will return this at the end of your trip, provided the vehicle is in good condition.
The security deposit is held by the company to cover any potential costs arising from:
- Damage to the vehicle during the rental period, including damage caused by reckless driving, accidents, or other incidents.
- Unpaid charges, such as fuel, late return fees, or fines.
- Loss or theft of accessories or parts of the vehicle.
The security deposit ensures that the vehicle is properly cared for and returned in good condition. If there are no issues, the deposit will be fully refunded. However, if there are any outstanding charges or damages, the appropriate amount will be deducted from the security deposit. If the deposit does not fully cover the costs, the Renter will be responsible for paying the remaining balance.
