Terms and Conditions

These terms apply to every self-drive rental with NOHA TUKTUK, whether booked online, on WhatsApp, or through a booking partner.

Our commitments to you

We aim to:

  • Deliver your vehicle at least 30 minutes before your rental period begins, at the agreed location.
  • Provide the exact vehicle type you booked, unless you approve an alternative.
  • Hand over all keys and accessories needed to operate the vehicle.

If we can't meet these commitments, we'll notify you at least 48 hours in advance so you have time to arrange an alternative vehicle.

Your responsibilities as the renter

You must:

  • Be the sole driver of the vehicle, after a driving lesson from the NOHA team (tuk tuks only — not required for scooters and motorbikes) and while holding a valid Sri Lankan driving permit (see our driving permit guide).
  • Take responsibility for the actions and any mistakes of anyone you allow to drive the vehicle.

Using the vehicle during the rental

During your rental, you must:

  • Check and top up brake and engine oil to the manufacturer's specifications, daily or every other day, and cover the cost of maintaining these levels during the rental.
  • Grease the tuk tuk at a local service centre every 1,000 km.
  • Not use the vehicle, or allow it to be used, for any illegal purpose, racing, contests, performance tests, or in violation of any law.
  • Not use the vehicle to push or tow anything.
  • Not carry more than the vehicle's maximum capacity: 3 passengers in a tuk tuk, 1 passenger on a motorbike or scooter.
  • Not drive under the influence of alcohol or drugs, or with a blood alcohol level above the Sri Lankan legal limit.
  • Not drive the vehicle if it is damaged or unsafe.
  • Not drive the vehicle after an accident or collision (including hitting an animal) until NOHA TUKTUK approves it.
  • Not transport flammable substances with a flashpoint, or any explosive or corrosive materials.
  • Not place anything on the tuk tuk roof unless it has roof racks; roof racks may only carry surfboards, and no one may sit or stand on the roof.
  • Not exceed the speed limits: 40 km/h in a tuk tuk, 60 km/h on a scooter or motorbike.
  • Comply with all local and international laws governing the use and driving of the vehicle.
  • Reimburse us for any lost, stolen, or downgraded items or accessories during the rental.
  • Return the vehicle as clean as it was provided — a fine applies if you don't.
  • Pay all parking, speeding, traffic violation, and toll charges incurred during the rental.

Where you can and cannot drive

You may:

  • Use the vehicle only on a properly formed, constructed road — sealed, metalled, or gravel.
  • Use the vehicle only on roads in Sri Lanka where it is registered and legally approved for travel under Sri Lankan law.

You may not:

  • Use the vehicle off-road — for example on a fire trail, beach, track, or grassed area, or to cross a stream or any other body of water.
  • Drive in areas affected by natural disasters, such as floods, landslides, or tsunami zones.
  • Drive the tuk tuk near wild animals, such as elephants, that could endanger you or the vehicle.

If you don't follow these rules and the vehicle is damaged, you're responsible for the repair costs.

Maintenance, security, and safety

You must:

  • Keep the vehicle locked when unattended, and keep the keys under your personal control at all times.
  • Not carry out any repairs unless we authorise them. To be reimbursed for an authorised repair, give us the original tax invoice or receipt — we reimburse verified mechanical repairs only.

We'll assist with repairs for any inherent mechanical fault — as determined by us or our authorised repairer — at no extra cost, as long as it wasn't caused by unauthorised use of the vehicle or a breach of these terms.

Repair and damage costs are calculated from our spare parts and mechanical repair cost document. For anything not listed there, we'll get a quote from a reputable mechanic and agree the amount with you before settling any refund.

Any damage or loss you cause is deducted from the security deposit. If the deposit doesn't cover the full cost, you pay the balance.

Returning the vehicle

Return the vehicle to us:

  • At the agreed location, date, and time — unless you tell us about a change before the return date and we agree to it.
  • In the same condition as when you received it, except for normal wear and tear.

If the vehicle is returned at a different time, date, or location than agreed, a one-way fee of up to USD 2 per kilometre may apply to return it to the original location. You're also responsible for any additional rental charges caused by loss, damage, a late return, or other issues.

Extending your rental

If you need to extend, tell us at least 2 days before your scheduled return date. We'll do our best to accommodate it based on availability and scheduling.

  • Extension fees: the additional rental charges are due the same day the extension is confirmed. If payment is delayed, a 10% fee is added to the extension charges for each day of delay.
  • Late return without notice: if the vehicle is returned late without prior notice, a fee of the daily rental rate plus 50% applies for each additional day.

To avoid extra charges, let us know in advance if you expect a delay or need an extension.

Fuel

We provide the vehicle with at least 2 litres of fuel at the start of the rental. Return it with at least the same amount, or you'll be charged for the missing fuel.

We check the fuel gauge visually and consider the distance driven to determine the level at return. Any fuel service charge is based on the actual amount of fuel needed to refill the vehicle to its original level.

Damage, loss, and accidents

You're responsible for any loss or damage to the vehicle during your rental, and for damage to other people's property caused by you or anyone driving the vehicle with your permission. Contact us immediately if a collision occurs.

We're not responsible for injury to the driver or passengers, but we'll help you claim compensation from insurance where it's available.

You're responsible for costs such as:

  • Repairing damage caused by reckless driving, water damage, or damage to accessories.
  • Replacing lost or stolen accessories.
  • Compensating us for lost income while the vehicle is out of service due to damage — around USD 10/day for a tuk tuk, USD 5/day for a motorbike or scooter.
  • Towing and administrative fees.

The amount you pay for damage is either the cost of repairs or the market value of the vehicle, whichever is less. We can charge these costs to your account and will refund any excess if the final costs come in lower than first charged.

Refundable deposit

Nothing is charged in advance. The refundable deposit is taken when you collect the vehicle: USD 100 for a scooter or motorbike, USD 120 for a tuk tuk, and USD 200–500 for a car depending on the model. Pay by cash, card, Google Pay, Apple Pay, or a payment link we send on WhatsApp, in USD, EUR, GBP, or LKR.

The deposit covers costs arising from:

  • Damage to the vehicle during the rental, including damage from reckless driving, accidents, or other incidents.
  • Unpaid charges, such as fuel, late return fees, or fines.
  • Loss or theft of accessories or parts of the vehicle.

Card deposits are charged rather than held, and refunded within two weeks of your rental ending. If your card is issued in EUR or GBP, your bank converts twice and the refund can come back slightly under what you paid — paying in cash avoids this.

If there are no issues, the deposit is refunded in full. If there are outstanding charges or damage, we deduct the appropriate amount, and if the deposit doesn't cover it you pay the balance.

Payment

Payment is taken on collection by cash, card, Google Pay, Apple Pay, or a payment link we send on WhatsApp. Nothing is charged in advance and there are no card fees. Accepted currencies: USD, EUR, GBP, LKR.

Governing law

These terms are governed by the laws of Sri Lanka, where NOHA Tuk Tuk (Pvt) Ltd. (PV 00311498) is registered.

Changes to these terms

We may update these terms from time to time. The date above shows when they were last revised.
